The company Explicaire s.r.o., IČO: 19890770 with its registered office at Plovární 478/1, Jižní Předměstí, 301 00 Plzeň, registered in the Commercial Register kept by the Municipal Court in Plzeň, Section C 44440/KSPL (hereinafter also referred to as "We") as the controller of personal data, hereby informs you as visitors to our websites, users of the GuideGlare application, our customers, suppliers, and collaborators about the collection of personal data and privacy principles described below.

The protection of your personal data is important to us, and therefore we will always be guided by these principles in our relationship with you. This privacy policy explains in particular:

  • what personal data of yours we will process,
  • for what purposes and in what manner we will process your personal data and the legal basis for their processing,
  • to whom your personal data may be transferred,
  • for how long we will process your personal data,
  • what rights you have in relation to the protection of your personal data.

SCOPE OF PERSONAL DATA PROCESSING

We process various data depending on how you use our services.

  1. When visiting our websites (www.guideglare.com):
    • Cookies and website usage data (more in the Cookies section).
  2. When registering and using the GuideGlare application at app.guideglare.com (hereinafter "Application"):
    • First and last name,
    • email address, phone number,
    • address (including billing address), IČO, DIČ, company name
    • other personal data necessary for the fulfillment of our mutual obligation,
    • cookies and Application usage data.
  3. When contacting us (e.g., via the contact form or as a potential customer):

    If you contact us (e.g., as our potential customer) (either through the website www.guideglare.com or by other means), you will be asked to provide certain information about yourself, which we will further process, and these are:

    • First and last name,
    • email address and phone number.

COOKIES

Our websites and the Application use cookies (small text files placed on your device) to provide services and collect data. The text in a cookie file is often a series of numbers and letters that uniquely identify your computer, but it may also contain other information.

PURPOSE AND LEGAL BASIS OF PROCESSING

If you are visitors to our website or users of the Application, we process your personal data in the form of cookies as stated above, based on our legitimate interest, which consists in our interest in monitoring the use of our services and improving them. We will only process your personal data for the purpose mentioned above. Providing the above data is not a requirement from us, but without this data, some functions of our websites or the Application may be limited. Your personal data will not be used for any solely automated decision-making, including profiling based on such decision-making.

If you are a job applicant with us, we process your personal data based on our legitimate interest, which consists in our interest in filling our vacant positions and in your interest in obtaining employment according to your expectations. The purpose of the processing is therefore to find a suitable candidate for the vacant position we are offering. We use the data you provide to contact you about the status of the selection process. We will only process your personal data for the purpose mentioned above, and if you are interested in a specific job position, we will process personal data only for the purpose of filling that position, or for positions similar to the one you are applying for. Providing the above data is our requirement, and without providing it, we cannot include you in the selection process. Your personal data will not be used for any solely automated decision-making, including profiling.

If you are a job applicant with us, you may also give us your consent to the processing of personal data for the purposes of selection procedures.

If you are our customers, suppliers, or users of the Application, we process your personal data mainly because it is necessary for the performance of a contract or for compliance with legal obligations (especially tax and accounting), or on the basis of a legitimate interest (which consists mainly in improving our services and contacting you with our offers). The purpose of the processing is therefore primarily to ensure the smooth implementation of our business relationship and the further development of joint business cooperation. We can use your name, surname, and email address to send you business and marketing communications and invitations to events, fairs, and workshops, i.e., to provide you with information that we believe might be interesting and beneficial for you. We may also use your personal data for our internal needs, particularly for monitoring your satisfaction, optimizing and improving the quality of provided products and services, developing new products, and reducing risks. Providing personal data for the performance of a contract and for compliance with a legal obligation is our requirement, and failure to provide it may be a reason for not concluding a contract or for terminating the business cooperation.

WHO HAS ACCESS TO YOUR PERSONAL DATA

Your Personal Data may be processed by processors for us as part of providing certain activities. These are mainly the following categories of partners and services:

  • Entities that provide us with server, web, cloud, or IT services.
  • Entities that provide us with accounting services.
  • Entities that provide us with legal services.
  • Entities that provide us with payment services.
  • Processors who provide us with other services – consulting, audits, and other external services.

Specific Processors and Third-Party Services

Google (Cloud, Ads, Analytics, OAuth)

Google Cloud Platform: Your personal data may be stored on the Google Cloud Platform, which we use to ensure the secure and reliable operation of our services. The data is processed in data centers within the European Union.

Google Ads and Google Analytics: On our website and in the Application, we use these tools for traffic analysis and providing personalized advertising. The services collect information using cookies. For more information, please see Google's Privacy Policy.

Sign-in with Google and Data Usage (Google OAuth)

Our application allows you to register and sign in using your Google account. If you choose this option, we will collect and process information from your Google account in accordance with their policies and terms.

Data Access: We only access basic profile information from your Google account, specifically your name and email address.

Data Usage: We use this data exclusively for the following purposes:

  • Authentication and Sign-in: To simplify the registration and sign-in process for your application.
  • Personalization: To display your name in the application's user interface.
  • Communication: To address you by name in the email communications we send you.

Data Storage and Sharing: Your name and email address are securely stored in our database. We do not share this information with any third parties.

Our handling of information received from Google Accounts fully complies with the Google API Services User Data Policy, including the Limited Use requirements.

Stripe

For financial transactions related to the purchase of subscriptions or other one-time payments in the Application, we use the payment solution from Stripe, Inc. (https://stripe.com). For more information on how Stripe collects and uses your data, please visit their Privacy Policy.

Microsoft Clarity and Microsoft Advertising

We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising. Meta (Pixel and Ads)

PERIOD OF PERSONAL DATA PROCESSING

We will process your personal data for the period during which we provide you with our services or fulfill our mutual contract, for the duration of our legitimate interest, or for the period necessary to fulfill archiving and other obligations under applicable legal regulations, such as the Accounting Act, the Archiving Act, the Value Added Tax Act, and others.

We will retain your personal data for as long as necessary to provide our services and complete the requested transactions, or for other essential purposes such as complying with our legal obligations, resolving disputes, and enforcing our agreements.

However, if you contact us (for example, by email at gdpr@explicaire.com), we will always inform you of the exact processing period for your personal data.

YOUR RIGHTS ARISING FROM THE PROCESSING OF PERSONAL DATA

In relation to the processing of your personal data by us, you have the following rights:

  • The right of access to personal data,
  • the right to rectification,
  • the right to erasure,
  • the right to restriction of processing,
  • the right to data portability,
  • the right to object to processing,
  • the right not to be subject to a decision based solely on automated processing, including profiling,
  • the right to lodge a complaint regarding the processing of personal data.

Your rights are explained below so that you can get a clearer idea of their content.

The right of access means that you can at any time request our confirmation as to whether or not personal data concerning you are being processed, and if so, for what purposes, to what extent, to whom they are disclosed, how long we will process them, whether you have the right to rectification, erasure, restriction of processing or to object, from where we obtained the personal data, and whether automated decision-making, including profiling, occurs in the processing of your personal data. You also have the right to obtain a copy of your personal data, with the first provision being free of charge, and for subsequent provisions, we may charge a reasonable fee for administrative costs.

The right to rectification means that you can ask us at any time to correct or supplement your personal data if it is inaccurate or incomplete.

The right to erasure means that we must erase your personal data if (i) it is no longer necessary for the purposes for which it was collected or otherwise processed, (ii) the processing is unlawful, (iii) you object to the processing and there are no overriding legitimate grounds for the processing, (iv) we have a legal obligation to do so, or (v) you withdraw the consent given for the processing of personal data.

The right to restriction of processing means that until we resolve any disputes regarding the processing of your personal data, we must not process your personal data other than by storing it, and we may only use it with your consent or for the establishment, exercise, or defense of legal claims.

The right to data portability means that you have the right to receive personal data concerning you, which is processed by automated means and on the basis of consent or contract, in a structured, commonly used and machine-readable format, and the right to have this personal data transmitted directly to another controller.

The right to object means that you can object to the processing of your personal data that we process for direct marketing purposes or on the basis of a legitimate interest.

If you object to processing for direct marketing purposes, your personal data will no longer be processed for these purposes. In the case of an objection to processing based on a legitimate interest, this objection will be evaluated, and we will then inform you whether we have complied with it and will no longer process your data, or that the objection was not justified and the processing will continue. In any case, processing will be restricted until the objection is resolved.

The right not to be subject to a decision based solely on automated processing, including profiling means that no decision by our company that has legal effects for you or similarly significantly affects you will be made through automated processing, including profiling. This does not apply if such processing is necessary for entering into, or performance of, a contract between you and our company, or if you give your explicit consent to this type of processing, or if such processing is permitted by a law to which our company is subject.

If you have comments or complaints regarding the protection of your personal data, or have a question for the person responsible for data protection in our company, or are exercising one of your rights, please contact us via our email address gdpr@explicaire.com. We will respond to your questions or comments within one month. This period may be extended by another two months if necessary and in view of the complexity and number of requests.

REPORTING SECURITY INCIDENTS

In the current era, characterized by the expansion of modern technologies, there is a possibility, however minimal, that your personal information could be leaked, misused, or lost. As part of our operations, we are committed to taking all possible steps to prevent any security breaches, which includes regular training of our employees who come into contact with your personal data on the protection of this data. We also implement internal rules to protect your information and ensure the use of the best available technical solutions, such as data encryption, complex passwords, and high-quality security software, to ensure the protection of your data.

Although we strive to prevent any security risk, in the event of a security incident that could endanger your rights and freedoms, we will immediately inform you of this situation via your email address and publish information about the incident on our websites along with all relevant details.

CHANGES TO THE POLICY

Our privacy policy may be changed from time to time. We will not reduce your rights under this privacy policy without your explicit consent. We will post any privacy policy changes on this page and, if the changes are significant, we will provide a more prominent notice (for certain services, we may notify you of privacy policy changes by email).
